We do not warrant that the functions contained in the material on this website will be uninterrupted or error free, that defects will be corrected, or that this site or the servers that make it available are free of viruses or represent the full functionality, accuracy or reliability of the materials. In no event will we be liable for any loss or damage, or any loss or damages whatsoever arising from the use, or loss of use, of data, or profits arising out of or in connection with the use of the Sealed Envelope website.
Free randomisation service
Access and use by you of our free randomisation service constitutes your acceptance of these terms and conditions. They take effect from the date on which you first use this service. We may at any time revise these terms and conditions without notice, and therefore they should be regularly checked. The continued use of the service after a change has been made is your acceptance of the change.
You may only use this service for clinical trials that are funded by non-commercial organisations such as charities, non-profit making organisations, universities and educational institutions, government and public bodies. Clinical trials that are part-funded by commercial organisations (such as pharmaceutical or medical device companies) may use this service provided the commercial sponsorship is less than 50% of the total funding.
You agree to use this service only for lawful purposes, and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of this service by any third party. Such restrictions or inhibitions includes, without limitation, conduct which is unlawful, or which may harass or cause distress or inconvenience to any person, and the transmission of obscene or offensive content or disruption to the normal operation of this service.
In the event that we, at our sole discretion, considers that you are making any illegal and/or unauthorised use of the service, and/or your use of the service is in breach of these terms and conditions, we reserve the right to take any action that we deem necessary, including terminating without notice your use of the service, removing trials from the service, and, in the case of illegal use, instigating legal proceedings.
If you purchase additional randomisations for a trial these are non-refundable and non-transferable.
We may suspend the service at any time and for any reason whatsoever, including but not limited to repairs, planned maintenance or upgrades, and shall not be liable to you for any such suspension. We reserve the right to make any changes to the service or to discontinue any aspect or feature of the service without notice.
You may print and keep a copy of these terms and conditions, which form the entire agreement between you and us and supersede any other communications or advertising with respect to the service.
These terms and conditions and their performance shall be governed by and construed in accordance with the laws of England and Wales and the parties hereby submit to the exclusive jurisdiction of the courts of England.
You shall comply with all foreign and local laws and regulations which apply to your use of this service in whatever country you are physically located, including without limitation, consumer law, export control laws and regulations.
If any provision of these terms and conditions is declared void, illegal, or unenforceable, the remainder of these terms and conditions will be valid and enforceable to the extent permitted by applicable law. In such event, the parties agree to use their best efforts to replace the invalid or unenforceable provision by a provision that, to the extent permitted by the applicable law, achieves the purposes intended under the invalid or unenforceable provision.
Any failure by any party to these terms and conditions to enforce at any time any term or condition under these terms and conditions will not be considered a waiver of that party's right thereafter to enforce each and every term and condition of these terms and conditions.
Neither party will be responsible for delays resulting from circumstances beyond the reasonable control of such party, provided that the nonperforming party uses reasonable efforts to avoid or remove such causes of non-performance and continues performance hereunder with reasonable dispatch whenever such causes are removed.
Nothing in these terms and conditions shall give, directly or indirectly, any third party any enforceable benefit or any right of action against Sealed Envelope and such third parties shall not be entitled to enforce any term of these terms and conditions against Sealed Envelope.
